Our firm secures victory for Peaky Blinders producers

We are delighted to announce a successful outcome in a recent trade mark opposition handled by our firm.

Our client, Caryn Mandabach Productions  Ltd (CMP) — the producer of the globally acclaimed television series Peaky Blinders, starring Oscar-winner Cillian Murphy — entrusted us with safeguarding its valuable intellectual property.

The case concerned an opposition to the trade mark application “BY ORDER OF THE COFFEE BLINDERS”, filed in Cyprus by Protection Services Lads Ltd.

Acting on behalf of CMP, in filing the opposition, we invoked a series of our client’s earlier trade mark registrations relating to the “Peaky Blinders” franchise, arguing that since our client’s earlier registered trademarks are famous and enjoy wide recognition within the relevant public, the Applicant’s subsequent trade mark application would likely cause confusion amongst consumers, especially when considering that their proposed trade mark contained the likeliness of Cillian Murphy’s character on the menu.

The Registrar upheld our arguments and held that the proposed trade mark indisputably took unfair advantage of, or was detrimental to, the distinctive character or reputation of our client’s earlier trademarks and other intellectual property rights.
